This Privacy Notice (“Notice”) describes the types of information we collect, how we may use that information, to whom and under what circumstances we may disclose it, and how we protect it. We also tell you how to update your information or contact us with questions about our privacy practices. In order to use our Sites, a user must first complete a registration form. During registration a user is required to give certain information (such as name and email address). This information is used to process orders you have placed or to contact you about the products/services on our site in which you have expressed an interest. At your option, you may also provide demographic information (such as gender or age) about yourself, but it is not required.


We request information from you on our order form. To buy from us, you must provide contact information (like your name and mobile phone number) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we'll use this information to contact you.

Information we collect

When you use certain features of our Sites, we may collect personal information that you submit to us. We may also collect personal information automatically. The information we collect falls into three different categories: (1) information you give us; (2) information we collect from you automatically; and (3) information we collect from other sources. Some examples of when we collect this information include when you browse or make a purchase on one of our Sites; create a FAC account; use our Sites to purchase, reload or redeem a FAC Card; use the remote order and pay functionality in our mobile applications; buy or send a gift card or e-gift; or participate in a survey or promotion.

Information You Give Us

Some information we collect is provided by you when you use our services. This may include your first and last name, username, password, email address, postal address, phone number, financial account information such as a credit card number, birthday, demographic information (such as your gender), and any other information you give us. You may also permit us to access information directly from your Device, such as information in you contacts list. You may also provide us information about other people, including when you direct us to send a gift card or e-gift.

Information We Collect Automatically

Some information is collected by us automatically, including when you access our Sites, download and use our FAC mobile applications or otherwise use our services or install our applications. This information includes: 

Purchasing Information – We may collect information about your transactions in our kiosks, on our websites or via our FAC mobile applications including what products you purchase, how frequently you purchase them, and any rewards or promotions associated with a purchase.

Device and Usage Information –We may collect information about your browser or Device. This information may include the type of Device you are using, your operating system, your browser, your internet service provider, your domain name, your internet protocol (IP) address, your Device and mobile ad identifiers, the website that referred you to our Sites, the web pages you view (including the date and time you viewed them), the services or functionality you access or use (including the date and time of your access or use), and the subject of the ads you click or scroll over. To collect this information, we use cookies, web beacons and similar technologies.

Location Information –We collect information about the location of your Device, including GPS location, for purposes of enhancing or facilitating our services, such as enabling the functionality of our websites or mobile applications that provide you with information about kiosks near you, enabling you to remotely order and pay for our products and services. We may also use information about the location of the Device you are using to help us understand how our Sites and functionality are being used and to deliver more relevant advertising. If you want to opt out of the collection of this location information, please see the section below titled “Access, Correction and Deletion”. However, please understand that in order for you to order and pick up an item at a FAC kiosk, we MUST know your location and use GPS tracking to properly complete your order. THEREFORE, IF YOU DECIDE TO OPT OUT OF THE COLLECTION AND USE OF YOUR LOCATION INFORMATION YOU WILL NOT BE ABLE TO PURCHASE ITEMS FROM FAC.

As referenced above, we receive or collect other information using technology features such as:

Cookies. We use "cookies" on our Sites. A cookie is a piece of data stored on a site visitor's hard drive to help us improve your access to our Sites and identify repeat visitors to our Sites. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our Sites. Cookies can also enable us to track and target the interests of our users to enhance the experience on our Sites. Usage of a cookie is in no way linked to any personally identifiable information on our Sites.

Web Beacons. Our Sites may use web beacons, pixels, JavaScript, or other electronic markers that monitor some types of use. These beacons may provide us with information such as the IP address of the computer or other Device you used to access our Sites. We use this information to understand patterns of activity on our Sites, to improve features, and to customize our presentation of content to our users, including our advertising. Interest-Based Advertising. We may provide interest-based advertising about our products and services on other parties’ websites. We may use third-party advertising companies that use tracking technologies to serve our advertisements across the Internet. Referrer Headers. We may record referrer headers when you follow links to our Sites, which may be sent to us automatically by your web browser. In these cases, we may receive information such as the URL of the website that referred you to our Sites, or search queries you used to find our Sites. We use this information to understand our web traffic, to improve our services, to increase their accessibility to search engines and others, and to monitor our advertising campaigns.

Information We Collect from Other Sources

Some information we collect is publicly available. For example, we may collect information you submit to a blog, a chat room, or a social network like Facebook, Snapchat, Twitter or Google+. We may also collect information about you from other companies and organizations. By gathering additional information about you, we can correct inaccurate information, enhance the security of your transactions, and give you product recommendations and special offers that are more likely to interest you.

Examples of additional information we may collect includes:

  • Contact information for other people that you provide when you ask us to send them information (please do so only with their permission);

  • Payment information, such as payment card number, expiration date, billing address, cardholder name, security code, and promotional or discount code;

  • Information that you submit related to potential employment with FAC, such as your resume, work authorization status, educational information, employment history, names and contact details of past supervisors, and work experience; and

  • When you use social media to interact with us, or to share something from our Sites with others, we will receive information about what you share and other details that may be based on your social media privacy settings.

We may use the information we obtain about you for a variety of purposes, including:

  • Providing customized or targeted content, including interest-based advertising, and promotions/discounts based on your use of the Sites, your preferences, your purchases, and/or your location, depending on the type of information you have chosen to provide to us;

  • Operating, evaluating, enhancing, and improving our business, products, services, communications, and similar activities;

  • Analyzing, enhancing, and improving our online features, marketing communications, and marketing strategies;

  • Protecting against and preventing fraud, physical and financial loss, unauthorized transactions, claims, and other liabilities, and managing risk, including identifying unauthorized users or other security issues;

Even if you opt-out of receiving these messages, we reserve the right to send you certain communications relating to the services we provide, and we may send you service announcements and administrative messages. We take precautions to protect your information. When you submit sensitive information via the Sites, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of our Web page. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.


We respect your right to access and correct your personal information. You may access your personal information by signing into your account. From there, you can correct or modify your information. You may also exercise your rights, subject to applicable laws, to request that we delete or restrict access to your personal data. We may need to retain it for legally permitted purposes and this will be explained to you if necessary.

By contacting us as shown in the “Contact Us” section of this Policy, you may opt-out of receiving communications from us, such as newsletters and surveys. You also have the following specific opt-out choices:

  • Marketing communications. You may opt-out of specific communications (such as marketing emails, rewards program emails, and customer satisfaction surveys) by following the opt-out instructions contained in the footer of each communication or contacting us as provided below. In certain jurisdictions, we will market to you only with your express consent.

  • Cookies. Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. However, rejecting cookies may affect your user experience, and you may not be able to access or use certain features of our Sites. In addition, disabling cookies may invalidate opt-outs that rely on cookies, such as web analytics or targeted advertising opt-outs. Because FAC does not own or control browser tools, we cannot guarantee their effectiveness.

  • Mobile Devices and geographic location. When you use our Sites on your mobile Device, you may choose not to share your location with us by adjusting the Device’s location services settings. FAC Sites are not directed at children under the age of 13 and FAC does not knowingly solicit or collect personal information from children under 13 without prior verifiable parental consent. If FAC learns that a child under the age of 13 has submitted personal information to us without parental consent, we will take all reasonable measures to delete such information from our databases and/or to not use such information for any purpose (except as necessary to protect the safety of the child or others as required or allowed by law). Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt-out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, FAC does not recognize DNT.
